Data protection notice

1 General information

We take the protection of your personal data, and accordingly, the protection of your pri-vate sphere, very seriously. We would therefore like to take this opportunity to describe what happens when you use our personalized services, as well as the means by which we protect your data and inform you of the information to be conveyed according to Articles 13 and 14 of the General Data Protection Regulation (“GDPR”). In order to ensure the greatest possible protection of your private sphere we consider it self-evident that we comply with all the statutory provisions in relation to data protection.

The following data protection information applies to the online offerings of Förster Tech-nik GmbH at www.foerster-technik.de (the “Website”), with the associated dealer section (the “Dealer Section”), as well as the online shop www.colostroshop.de (the “Online Shop”) (together the “Online Offerings“). This data protection information therefore ap-plies to all of these online offerings unless a specific web offering is expressly referred to.

Personal data means all information relating to an identified or identifiable natural per-son. This includes information such as your name, address, phone number and email ad-dress, as well as information about your usage of our web offerings.

1.3 Use for the intended purpose

We will only process the personal data you provide online for the purposes we have de-clared to you below. We will exclusively disclose your data to the recipients specified be-low in this document. Moreover, we will not transfer your personal data to third parties unless you have given the necessary permission.

Our employees and the service providers mandated by us have undertaken to maintain confidentiality and to comply with the provisions of the GDPR and the German Federal Data Protection Act (Bundesdatenschutzgesetz – “BDSG”).

1.4 Recipients of personal data

We disclose the data specified below to our hosting providers. They work for us as con-tract data processors. For the website, this is done by Netshake medien und technologie Gmbh, Payerstraße 5, 70184 Stuttgart. For the online shop, Jimdo GmbH, Strese-mannstr. 375, 22761 Hamburg (“Jimdo”). These recipients are all based in the EU.

2 Processing of personal data when using the online offerings

As described below, we process personal data both when our web offerings are used sole-ly for information purposes as well as when you use the online shop or dealer section, purchase goods or information from us, or otherwise wish to contact us.

2.1 Use of the web offerings for information purposes

For technical reasons, we process the following data every time our web offerings are accessed:

  • the pages visited,
  • the web browser and operating system used,
  • date and time of access,
  • search engines used,
  • files downloaded and
  • your IP address.

We evaluate this technical data solely for statistical purposes to continually further opti-mize our Internet presence and make our Internet services still more attractive. This anonymized data is stored separately from personal information on backed-up systems. Your personal data and your private sphere are thus protected at all times.

We temporarily process on our web server the aforementioned data in order to provide the website contents called up by the user. To ensure the security of the IT infrastructure used to provide the website, the data is temporarily processed in web server log files, es-pecially for determining, remedying and evidence-compliant documentation of faults (e.g. DDoS attacks). We store this data for up to 31 days in the web server log files.

The lawful basis for this processing is a weighing of interests (Art. 6(1)(f) GDPR). By pro-cessing the data, we pursue the legitimate interests of providing to you the content you requested and ensuring the security of the IT infrastructure.

The provision of this data is not required by law or contract, or in order to conclude a con-tract. The website, however, cannot be accessed unless the data is provided.

2.2 Processing of personal data when using the online shop

Additional personal data is necessary to open a customer account and process orders. The required data is marked with an asterisk (*) on the registration form; provision of the in-formation is voluntary. If you do not provide the aforementioned data, however, you will not be able to conclude the contract with us.

We you use our online shops, we process personal data in order to enter into and execute the contract.

The lawful basis for this processing is the discharge of a contract to which you are a party, or to perform pre-contractual measures initiated upon your request (Art. 6(1)(b) GDPR). If you are not a party to such a contract or pre-contractual measures are not being per-formed with you, but rather with a company that you represent, the lawful basis for this process is a weighing of interests (Art. 6(1)(f) GDPR). By processing the data, we pursue the legitimate interest of enabling the (potential) customer to contact us easily and to discharge contracts with the customer or perform pre-contractual measures.

For processing payments we forward your payment data to the credit institute mandated to take the payment. Credit card data is not stored, but rather collected and processed di-rectly by our payment services provider PayPal (Europe) S.à r.l. et Cie, S.C.A. (“PayPal”). PayPal receives personal data for processing as a responsible party in its own right, for its own purposes. Your matters requiring protec-tion are handled in compliance with statutory provisions. Furthermore your data is for-warded to the delivery carrier, insofar as this is necessary for delivery of the goods, and to Jimdo.

We store this data for the statutory retention period of 10 years beginning at the end of the year in which the contract was concluded.

2.3 Processing of personal data when using the dealer section

We process your personal data if you wish to use the dealer section. This includes your name, address, employer and email address. You also freely choose a username and password for your access credentials.

We grant you access to the dealer section after validating your access authorization.

The lawful basis for this processing is the discharge of a contract to which you are a party, or to perform pre-contractual measures initiated upon your request (Art. 6(1)(b) GDPR). If you are not a party to such a contract or pre-contractual measures are not being performed with you, but rather with your employer, the lawful basis for this processing is a weighing of interests (Art. 6(1)(f) GDPR). By processing the data, we pursue the legitimate interest of making it possible to contact us easily and to discharge contracts with your employer or perform pre-contractual measures.

We store this data until you notify us that you no longer require access to the dealer section.

If you wish to register, provision of the data in the fields marked with an asterisk (*) on the registration form is mandatory. Access to the dealer section cannot be granted unless the data is provided.

2.4 Processing of personal data when using the contact form

We process your customer data when you use one of the contact forms provided. This contact information includes your name, email address and the subject of your inquiry. When you use the contact form, we process your contact information for the purpose of responding to your inquiry.

The lawful basis for this processing is the discharge of a contract to which you are a party, or to perform pre-contractual measures initiated upon your request (Art. 6(1)(b) GDPR).

If you are not a party to such a contract or pre-contractual measures are not being per-formed with you, but rather with your employer, the lawful basis for this processing is a weighing of interests (Art. 6(1)(f) GDPR). By processing the data, we pursue the legitimate interest of making it possible to contact us easily and to discharge contracts with your employer or perform pre-contractual measures.

If your inquiry is neither aimed at discharging a contract nor performing pre-contractual measures, the lawful basis is a weighing of interests (Art. 6(1)(f) GDPR). By processing the data, we pursue the legitimate interest of making it possible to contact us easily.

The personal data is stored for up to one year.

The provision of this data is not required by law or contract, or in order to conclude a con-tract. You are not obligated to provide the personal data. You will not be able to contact us via the website, however, unless you provide the data.

3 Cookies

3.1 General information on the use of cookies

The use of cookies enables us to provide user-friendly information to users of our website. This cannot be done without the use of cookies. We optimize our information and services on the basis of data collected by cookies. We use the cookies to fill the shopping basket and at subsequent visits to the website to display the goods still in the shopping basket. Cookies can permit automatic logging in to the shop. Your browser can also be configured so as to prohibit generally the use of cookies for our website. You can also use the rele-vant browser function to delete cookies stored on your computer.

Without the use of cookies in some circumstances some parts of the website may be usa-ble only to a limited extent or may not be usable at all.

3.3 Google Analytics

Various cookies are used in our web offerings in the course of performing Google Analytics. These may vary over the course of time. Therefore at this point we summarize the use of Google Analytics only in general terms:

this website uses Google Analytics from Google Inc. (1600 Amphitheatre Parkway Moun-tain View, CA 94043, USA; “Google”).

Google Analytics permits a pseudonym ID to be assigned to data, sessions and interactions over multiple devices. This permits the analysis of user activities across multiple devices.

These cookies are text files stored on your computer which are used to analyze the use of the website. To do so, we use the function ”IP anonymization”. As such, the data is pro-cessed within an EU country or another country within the EEA that is a signatory of the convention. In exceptional cases it may happen that the full IP address is forwarded to a server in the USA, where it is first truncated. The IP address transmitted from your browser within the scope of Google Analytics is collated with other Google data. Under our contract, Google evaluates the data and provides us with reports about website activi-ties and usage. Furthermore Google also renders additional services associated with use of the website and Internet. Our legitimate interest in processing the data is also based on this purpose. The lawful basis for this processing is a weighing of interests in accord-ance with Art. 6(1)(f) GDPR. After 14 months, data collected by the cookies in this way is automatically deleted.

You can configure the management of the cookies for settings in your browser software.

You can install a browser add-on (https://tools.google.com/dlpage/gaoptout?hl=de) that prevents Google from processing the data. To do this you must download and install the browser add-on. If you wish to achieve this on several devices, you must install the add-on for all those devices.

5 Your rights

You always have the right to assert your statutory rights in connection with personal data. To exercise your rights, please apply directly to our Data Protection Officer. You will find his contact data at the top of this document. Every data subject can exercise the following rights. Please note that these rights may be subject to statutory restrictions, in particular according to the GDPR and BDSG.

5.1 Right to information

Every data subject has the right to obtain a summary and copy, as provided for according to Art. 15 GDPR, of their personal data that has been processed.

5.2 Right to correction

Every data subject has the right, as provided for according to Art. 16 GDPR, to obtain cor-rection of any of their processed personal data that may be incorrect or incomplete.

5.3 Right to deletion

Every data subject has the right, as provided for according to Art. 17 GDPR, to obtain the deletion of their personal data that has been processed.

5.4 Right to restriction

Every data subject has the right to restrict the further use of their processed personal da-ta as provided according to Art. 18 GDPR.

5.5 Right of refusal

Every data subject has the right to refuse processing of their personal data for further use as provided according to Art. 21 GDPR, provided the lawful basis for the processing is to safeguard a legitimate interest (Art. 6(1)(f) GDPR.

5.6 Right of data portability

Every data subject has the right, as provided according to Art. 20 GDPR, to have their pro-cessed personal data forwarded to third parties in a machine-readable format for further use.

5.7 Right of revocation

If the processing of personal data takes place on the basis of your permission, you have the right revoke your permission at any time; this does not, however, affect the legality of the processing carried out on the basis of your permission before permission was revoked.

5.8 Complaints office

Every data subject has the right to file a complaint with a supervisory authority if they suspect that the processing of their personal data violates the GDPR. 6 Updating the data protection notice

This data protection notice will continually be updated in respect of the functions, tech-nologies and the applicable statutory requirements. Such updating will occur at irregular intervals. The authoritative version of the data protection notice is the one provided on the website.
